1. General terms
At mindwhistle, we value your trust and are committed to providing a safe, confidential, and professional experience.
These Terms of Service and accompanying Privacy Policy set out the agreement between mindwhistle (the “Psychologist”, “we”, “us”, “our”) and you (the “Client”, “you”) and apply to the provision of performance psychology services delivered online.
By visiting our website, attending an online session, or using all or any part of our services, you confirm that you have read, understood, and agree to be bound by our Terms of Service and Privacy Policy as if this agreement were signed by you. If you do not so agree, you may not access or use mindwhistle services.
By using the Services you agree to follow these terms. If you do not agree, you should not use the Services and should stop using the website and AI Assistant.
2. Nature of Services
Performance psychology focuses on enhancing pre-match preparation, performance mindset, and post-match reflection.
Sessions may include goal setting, psychological skills training, reflective discussion, and evidence-based strategies tailored to performance needs.
We do not provide mental health support, and our services are not a substitute for clinical mental health treatment.
3. Online Sessions, Technology, and Security
Online sessions are delivered via secure, GDPR-compliant video platforms such as Zoom / Microsoft Teams / Google Meet.
You acknowledge that:
- Online sessions can be effective but may have limitations compared with face-to-face meetings;
- Technical issues may occasionally disrupt sessions;
- Make clear that the content is for guidance and education, not medical treatment.
- You agree not to record or share session content without prior written permission;.
- We will not be liable for interruptions, data breaches, or other issues caused by external service providers or internet failures.
Session packages are subject to the terms as advertised and/or agreed, in respect of price, content and duration/expiry.
The AI Assistant is the property of Sporti. Please contact Sporti for further details.
4. Fees and Payment
Standard session fees are £99.00 per 45-minute session unless otherwise agreed in writing.
Payment for individual sessions is required on booking, via online payment link or bank transfer. Invoices available on request.
For session packages an invoice will be issued. Payment to be made within 14 days of date of invoice.

Unpaid or overdue fees may result in cancellation of session, and suspension of further appointments until the balance is cleared.
5. Cancellations and Missed Sessions
A minimum of 48 hours’ notice is required to reschedule or cancel a session.
Sessions cancelled with less than 48 hours’ notice, or missed without notice, will be charged in full.
Frequent cancellations may lead to review or termination of the professional arrangement.
6. Emergencies and Crisis Situations
Online performance psychology services are not suitable for crisis or emergency situations.
The Psychologist does not provide on-call or emergency support.

7. Termination of Services
Either party may end the professional relationship at any time.
Where possible, at least one session’s notice will be provided to allow for an appropriate closure or referral.
The Psychologist reserves the right to terminate services if:
- The work is no longer beneficial or appropriate;
- Terms of this agreement are breached;
- Ethical or professional conflicts arise.
8. Disclaimer
Your use of the services is at your sole risk. The services are provided on an “as is” and “as available” basis. mindwhistle disclaims all warranties and representations (express, implied, oral or written) with respect to these terms, the services, the mindwhistle material, the ai assistant, any third party services, whether alleged to arise by operation of law, by reason of custom or usage, by course of dealing or otherwise, including any warranties of fitness for purpose.
To the fullest extent permitted by applicable law, mindwhistle does not warrant, and disclaims all liability for (a) the completeness, accuracy, availability, timelines, security or liability of the services or any mindwhistle material, (b) any harm to your computer system, loss of data, or other harm that results from your access to or use of the services or any mindwhistle material; (c) the deletion of or any failure to store or transmit, any communications maintained by the service; (d) whether the service will meet your requirements or be available on an uninterrupted, secure and error-free basis, and (e) the content and nature of any information or advice you receive from professionals via the services. You acknowledge that you are responsible for your use of any information or advice received in the course of using the services from mindwhistle and/or its professionals. No advice or information, whether oral or written, obtained from mindwhistle or through the service, will create any warranty not expressly made in these terms.
9. Limitation of Liability
To the fullest extent permitted by law, mindwhistle shall not be liable for any loss of profit, loss of revenue or any indirect, incidental, or consequential loss or damage arising from the use of its services, including but not limited to technology failures or third-party service disruptions. Any liability of the mindwhistle shall be limited to the greater of £99 or the amount you have paid to mindwhistle for services during the period within which the damage arose.
10. Intellectual Property
Any written materials, frameworks, or psychological tools provided during sessions remain the intellectual property of mindwhistle and may not be reproduced, distributed, or shared without prior written consent.
11. Governing Law
These Terms and any related disputes shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Agreement
By proceeding with our online services and sessions, you confirm that:
- You understand the nature and purpose of performance psychology;
- You consent to receive services and sessions online; and
- You agree to these Terms of Service and Privacy Policy.
